“Boyle: New Pentagon War Manual Reduces Us To ‘Level of Nazis’”
Law of War Manual(LOWM) sanctioning nuclear attacks and the killing of civilians, "reads like it was written by Hitler's Ministry of War," says international law authority Francis Boyle of the University of Illinois at Champaign.
"Historically, this is a terrible development," he added in an exclusive interview with this reporter. "We are reducing ourselves to the level of the Nazis."
The grim, 1,165-page-long document, issued in June by the Defense Department's Office of the General Counsel, also sanctions the use of napalm, herbicides, depleted uranium, and drone missile strikes, among other barbarities.
Boyle points out the new manual is designed to supplant the 1956 U.S. Army Field Manual 27-10 written by Richard Baxter, the world's leading authority on the Laws of War. Baxter was the Manley O. Hudson Professor of Law at Harvard Law School and a Judge on the International Court of Justice. Boyle was his top student.
Boyle today is the leading professor, practitioner and advocate of international law in America. He drafted the U.S. implementing legislation for the 1972 Biological Weapons Convention known as the Biological Weapons Anti-Terrorism Act of 1989.
"Over the years, 27-10 has proven to be a total embarrassment to the Pentagon because it sets forth a fair and accurate statement of the Laws of War both as of 1956 and as of today," Boyle says. He termed the new manual a "warmongering" document.
The new document seeks to distinguish between "legitimate" and "illegitimate" acts of military violence against civilian targets, using the criterion of military necessity," points out Peter Martin of the World Socialist Website.
"Thus, acts of mass slaughter of civilians could be justified if sufficient military advantages were gained by the operations."
The bulk of the document, Martin continues, "amounts to a green light for military atrocities, including mass killings."
Martin said the most comprehensive previous such document, the 1956 Pentagon field manual, did not state that civilians, unlike military personnel, should be spared "unnecessary suffering" because it assumed... "that any deliberate targeting of civilians was illegal and a war crime."
Among the flagrant violations of international law sanctioned by the Pentagon's new LOWM, Martin writes, are:
# Legitimizing the use of nuclear weapons. LOWM states, "There is no general prohibition in treaty or customary international law on the use of nuclear weapons."
This flies in the face of a number of existing international covenants. Under the UN Charter as interpreted by the World Court in its Advisory Opinion on the Legality of the Threat or Use of Nuclear Weapons, even threatening to use nuclear weapons, as the U.S. and Israel have threatened Iran, is illegal and thus a war crime.
# Authorizing the use of banned incendiary weapons such as napalm, herbicides (as Agent Orange in Viet Nam), depleted uranium munitions (as used in Iraq). Napalm, for example, is banned under Protocol III of the 1980 UN Convention on Certain Conventional Weapons.
# Authorizing the use of cluster munitions, mines and booby-traps, the LOWM rationalizes that "the United States is not a Party to the Convention on Cluster Munitions." (That's a disgrace, of course, when the overwhelming majority of nations have signed it.)
# Defends drone missile attacks, both by the Pentagon and intelligence outfits such as the Central Intelligence Agency, declaring flatly: "There is no prohibition in the law of war on the use of remotely piloted aircraft-- To the contrary, targeted killing off the battlefield is prohibited.
# Authorizes the use of exploding hollow-point bullets, stating the U.S. is not a party to the 1868 St. Petersburg declaration banning their use. (At this writing, the U.S. is only 147 years late.)
In sum, the move by the Pentagon to supplant the 1956 manual with the LOWM represents an effort to justify the excesses of its trillion dollar-a-year war machine, one that is as large as the next dozen nations combined.
The Pentagon today operates some 900 military bases globally, allegedly for "defense," yet engages in warfare in a dozen foreign countries. The new Pentagon manual illuminates in bold print the downward drift of the U.S. from a democratic to a totalitarian society.
LOWM has received no play in a media "following orders to conceal from the American people" the Pentagon's preparations for new and more massive war crimes, along with the destruction of democratic rights spelled out in the U.S. Constitution," Martin says.
(Indeed, it seems TV "news" stations beam more commercials than news stories, and reports of any darnage inflicted by the Pentagon are virtually non-existent.)

Of all the July 4th think pieces I read this year, the most surprising was Kit Knightly’s piece for Off-Guardian.org, “America Was Never the Problem.”
I say “surprising” because most such Independence Day articles are written by and for Americans and are generally some variation of the lament that “kids these days don’t know what Independence Day is really about!” Knightly, however, is a Brit writing for an international (but presumably mostly British) audience, and he has a very different point to make.
To wit:
America was never the Empire, it was just where the Empire lived for a while.
It had other homes before, it will have others in the future. A hermit crab shedding shells as it swells.
The Nation of the United States—however you define the idea of nationhood—was as much a victim as any of us.
You should read the whole piece. It’s short and well-written and it makes an important point. The Global(ist) Empire has surely been headquartered in Washington for the last 80 years, but it isn’t a fundamentally American phenomenon. Rather, it’s a parasitical entity that has existed for centuries—perhaps millennia—and has infested various hosts over that time.
Now, it looks like the globalists are set to slough off their American skin and decamp to sunnier climes elsewhere.
But if they are about to make such a move, it raises an interesting question. Namely: where will the Empire move to next? Which country will these parasites infest next, and where will their next base of operations be located once America has been plunged into chaos and violence?
Today I offer some possibilities about where the Empire might go once it abandons the USA. . . . .

It started in the Sixties, when the CIA, with murderous assistance from the FBI, was doing all it could to depoliticize the left
Trump & Co.’s ongoing jihad against “wokeness” is (loosely) based on a belligerent misreading of our post-war history, which Charlie Kirk distorted time and time again, helping to provide Trump, Hegseth, Stephen Miller and the rest of them with fuel for their grotesque revisions of our nation’s past. According to that misperception, it all started with the civil rights movement in the Sixties, which, they think, ruined everything, and so must be repealed, its every trace wiped out—a vast, regressive project to sanitize our national history, and justify the degradation of America into a neo-Confederate (or crypto-Nazi) apartheid state.
Thus Kirk decried the Civil Rights Act as the evil source of all the “wokeness” that’s been stifling free speech, and exalting civil rights law that supersedes the Constitution (as Kirk and Trump et al. imagine it). “I have a very, very radical view on this, but I can defend it, and I’ve thought about it: We [sic] made a huge mistake when we passed the Civil Rights Act in the 1960s.” Apparently unfazed by the thought of everlasting Jim Crow segregation, and the permanent disenfranchisement of black Americans, Kirk saw the Civil Rights Act as nothing more than the source of “a permanent DEI-type bureaucracy,” which made America—as Trump would say—“a dead country,” which he claims he’s brought to life again, by redacting the history of America, while jailing, killing, ousting or excluding all non-white people, whether citizens or not.

“My Conversation With Karl Marx About Donald Trump”

The following has been edited for clarity and length.
Norman Solomon: You’ve downplayed the importance of the individual in history. But the United States now has as president an individual who transformed power relations and the political landscape.
Karl Marx: I can assure you that he did not do that by himself. Power relations are class relations. And by the way, I never said individuals are irrelevant to history. I exhorted individuals to get involved in changing history.
NS: President Trump has rolled back gains from the last hundred years and more. Also, he’s mentally unstable, to put it mildly.
KM: The basics still hold. As I wrote in 1869 about a situation in France where a cult existed around a tyrant, the class struggle “created circumstances and relationships that made it possible for a grotesque mediocrity to play a hero’s part.”
NS: But now one highly dangerous and unhinged person has taken control of the U.S. government. And he got there with a majority of votes of the working class. It’s been a huge shock to have a virtual psychopath as president.
KM: Those you would call liberals like to disconnect such poisoned flowers from their historic roots. Victor Hugo was like that, as with so many commentators in your day, endlessly heaping their derision on the despicable despot. Hugo excelled at bitter and witty invective against Louis-Napoléon Bonaparte after the coup d’etat. As I pointed out, “The event itself appears in his work like a bolt from the blue. He sees in it only the violent act of a single individual. He does not notice that he makes this individual great instead of little by ascribing to him a personal power of initiative unparalleled in world history.”
NS: Actually, Trump does seem to insanely wield destructive power in ways unparalleled in world history.
KM: But he did not obtain that power through his own will. If you fixate on an individual personality, you’ve lost the historical plot.
NS: One sociologist, Dylan Riley, recently commented: “From a Marxist perspective, much of the left-liberal critique of contemporary American politics can be viewed as essentially petty bourgeois. It revolves around moral arguments advocating for equal opportunities and less social division and conflict.” And he added: “I think that Marx’s central point on this is to emphasize the importance of class struggle as the mechanism through which any class compromise is actually imposed. And if you miss that point then your politics are disabled from the get-go.”
KM: First, I’m glad to say that I am not a “Marxist,” given how much idiotic rubbish has been babbled by some who so label themselves. You can look it up, “Ce qu’il y a de certain, c’est que moi, je ne suis pas Marxiste.” But that aside – yes, certainly, there is just no way to reasonably talk oneself around the primacy of class struggle. The phrase might sound overly polemical to petty-bourgeois ears in the America of the 21st century, but that’s the most powerful engine driving history. You can deny or evade it, but you can’t really avoid it.
NS: Trump is a voraciously narcissistic capitalist, but he’s also flagrantly racist and misogynist.
KM: Of course, capitalism functions to oppress and divide the working class. Systems of racism mean more profits for the few. Likewise, women are exploited and underpaid for their labor. I wrote about this extensively.
NS: The horrible fact remains that we are now oppressed by an extremely reactionary vicious president aspiring to become an unlimited tyrant. And he harbors special hatred for women and people of color, with horrendous social impacts.
KM: Class struggle failed to result in the needed remedies to appalling human conditions, with some special victimizations within the working class. On this point, we could leave the last words to my comrade Friedrich Engels, who wrote in 1890: “The ultimately determining element in history is the production and reproduction of real life. Other than this neither Marx nor I have ever asserted. Hence if somebody twists this into saying that the economic element is the only determining one, he transforms that proposition into a meaningless, abstract, senseless phrase. The economic situation is the basis, but the various elements of the superstructure – political forms of the class struggle and its results, to wit: constitutions established by the victorious class after a successful battle, etc., juridical forms, and even the reflexes of all these actual struggles in the brains of the participants, political, juristic, philosophical theories, religious views and their further development into systems of dogmas – also exercise their influence upon the course of the historical struggles and in many cases preponderate in determining their form.”
NS: So, you and Engels agreed that many different forces shape history, yet one individual can conceivably make all the difference at certain junctures?
KM: Fred clarified his point further this way: “We make our history ourselves, but, in the first place, under very definite assumptions and conditions. Among these the economic ones are ultimately decisive. But the political ones, etc., and indeed even the traditions which haunt human minds also play a part, although not the decisive one.” And he went on: “There are innumerable intersecting forces, an infinite series of parallelograms of forces which give rise to one resultant – the historical event.”
NS: Well, right now the historical event that keeps happening often seems to be dominated one way or another by Donald Trump.
KM: Even if it seems that way, the main propellant of a current event can often look obvious while unfolding as optical illusion. As I noted back in 1843, “The demand to give up the illusions about its condition is the demand to give up a condition that needs illusions.” Never forget that a few live in obscene luxury while billions live in immiseration and billions of others are barely able to scrape together the essentials of life. The struggle between classes might seem an antiquated concept, but nonetheless it is the main factor that undergirds history, past, present and future.
NS: Some people complain that’s what you always say.
KM: That’s because it’s always true.

In 1775, most of the United States was still Indigenous land; however, even George Washington acknowledged that it would require a “great wall” to restrain European settlers from encroaching on Indigenous territory. Over 200 years of land transfers (in which lands previously inhabited by Indigenous people became official property of non-Indigenous people), the Indigenous population was gradually confined to small areas within the U.S.
1820-1864:
By 1820, settlers had moved well into the Midwest, displacing Indigenous inhabitants through conflict or the simple pressure of their presence. By 1834, the frontier reached as far as Kansas. In one astonishing 14-year period, starting in 1850 and motivated by mid-century gold finds, nearly the entire west coast of the United States transferred from Indigenous to U.S. hands.
